In the case of multiple deliveries of goods ordered in a single order but delivered separately, the period begins from the day on which physical possession of the last item is acquired.<\/p>\n<p>The right of withdrawal applies to consumers residing in Italy, in other European Union Member States, and in non-EU countries, subject to the specific conditions provided for international shipments (see the dedicated section).<\/p>\n<h2>Exclusions from the Right of Withdrawal: Customized Products<\/h2>\n<p><strong>Article 59, paragraph 1, letter c) of the Consumer Code<\/strong> excludes the right of withdrawal for the supply of &#8220;goods made to measure or clearly personalized&#8221;. Given the nature of Be-Bloomer&#8217;s business, it is important to distinguish three levels of customization, each with a different legal framework.<\/p>\n<h3>Level 1 \u2014 Standard Gadgets Without Customization<\/h3>\n<p>Gadgets purchased in their blank version, without any application of logo, printing, engraving, or embroidery, and in their intact original packaging, are <strong>fully subject to the 14-day right of withdrawal<\/strong>. This category includes, for example, catalog products ordered by solely selecting the color or size from the standard options, without any graphic processing.<\/p>\n<h3>Level 2 \u2014 Standard Gadgets With Graphic Customization<\/h3>\n<p>Catalog gadgets customized with logos, printing, laser engraving, pad printing, screen printing, sublimation, embroidery, custom Pantone colors, or other client-specific graphic processes <strong>are not subject to the right of withdrawal<\/strong> pursuant to Art. 59 letter c).<\/p>\n<p>In accordance with the guidelines of the AGCM (provision 26820\/2017) and case law, &#8220;clear customization&#8221; consists of processing requested by the consumer according to specific, non-standardized instructions that are not available in the catalog in their final form. Once the product is processed with the client&#8217;s brand or graphics, it cannot be returned to the market and sold to third parties.<\/p>\n<p>The exclusion of the right of withdrawal becomes effective from the moment graphic production is initiated, meaning from the client&#8217;s approval of the graphic proof.<\/p>\n<h3>Level 3 \u2014 Gadgets Made in a Custom Shape (Custom-Made)<\/h3>\n<p>Gadgets developed entirely based on the client&#8217;s design, with shapes, sizes, or structures not available in the catalog \u2014 for instance, products made with dedicated molds, articles developed from samples, or objects designed from scratch according to the buyer&#8217;s specifications \u2014 constitute the most typical category of &#8220;goods made to measure&#8221; pursuant to Art. 59 letter c).<\/p>\n<p>For this type of order, the rules governing <strong>contracts for work or services (appalto)<\/strong> apply (Articles 1655 et seq., 2222 et seq. of the Italian Civil Code), rather than those of a simple sale. Consequently:<\/p>\n<ul>\n<li>the right of withdrawal is <strong>entirely excluded<\/strong>;<\/li>\n<li>formal approval of a sample or prototype is required before starting mass production;<\/li>\n<li>a deposit is generally required during the order confirmation phase, as agreed upon in the quote;<\/li>\n<li>once the sample is approved and production begins, no disputes for aesthetic reasons or personal preference will be accepted, provided the finished product complies with the approved sample.<\/li>\n<\/ul>\n<p>For Level 3 orders, the specific conditions (timescales, deposits, sample approval, production tolerances) are detailed in the customized quote and accepted by the client before processing begins.<\/p>\n<h2>Sales to Consumers in the European Union<\/h2>\n<p>For sales to consumers residing in other Member States of the European Union, the same Italian regulations apply, as they implement Directive 2011\/83\/EU harmonized across the EU: 14 days for withdrawal starting from delivery, a 24-month legal warranty of conformity, and the same exclusions for customized products.<\/p>\n<p>The costs of returning the item in case of withdrawal are the responsibility of the consumer, as provided for by Art. 57 of the Consumer Code.<\/p>\n<h2>Sales to Non-EU Consumers<\/h2>\n<p>For shipments to consumers residing in non-EU countries, Be-Bloomer contractually recognizes the 14-day right of withdrawal under the same conditions provided for EU consumers, with the following operational specificities:<\/p>\n<ul>\n<li><strong>Customs duties, import VAT, and local fees<\/strong> incurred by the client to receive the goods <strong>are non-refundable<\/strong> by Be-Bloomer, as they are paid to the authorities of the destination country and not to the seller;<\/li>\n<li><strong>International return shipping costs<\/strong> are entirely the responsibility of the client, including any customs fees for the return shipment;<\/li>\n<li>at the time of the return shipment, the client must correctly fill out the customs declaration (CN22 or CN23 form for postal shipments, or equivalent for express courier) indicating the statement &#8220;<em>Returned goods \u2013 Failed sale<\/em>&#8221; or equivalent, to avoid the application of new import duties in Italy. In case of incorrect completion, the package may be rejected at customs;<\/li>\n<li>the refund includes the price of the product and the original standard shipping costs, excluding duties and customs fees of the destination country.<\/li>\n<\/ul>\n<h2>B2B Sales (Purchases with VAT Number)<\/h2>\n<p>Pursuant to Art. 3 of the Consumer Code, the right of withdrawal applies exclusively to consumers (natural persons acting for purposes unrelated to their entrepreneurial, commercial, craft, or professional activity). <strong>Purchases made by entities holding a VAT number, companies, or organizations in the exercise of their professional activity are not subject to the right of withdrawal<\/strong>.<\/p>\n<p>For professional clients, orders are regulated by the provisions of the Civil Code concerning sales (Articles 1490 et seq.) or contracts for work\/services (Articles 1655 et seq.) for custom-made products. The warranty for defects applies with a claim to be sent within <strong>8 days of discovering<\/strong> the defect, and the limitation period is one year from delivery.<\/p>\n<h2>Legal Warranty of Conformity<\/h2>\n<p>All products purchased on be-bloomer.com by consumers are covered by the <strong>24-month legal warranty of conformity<\/strong>, pursuant to Articles 128 et seq. of the Consumer Code. The warranty covers conformity defects of the product existing at the time of delivery that manifest within two years from that date.<\/p>\n<p>The warranty covers manufacturing defects, material defects, and non-conformities with respect to agreed specifications (for customized products: with respect to the approved proof or sample). Defects resulting from improper use, normal wear and tear, accidental damage, or modifications made by the client after delivery are not covered.<\/p>\n<h2>Defective or Non-Conforming Products<\/h2>\n<p>In case a product is delivered defective, damaged during transport, or non-conforming to the order (for customized products: non-conforming to the approved proof or sample), the client is invited to report the issue within <strong>8 days of receipt<\/strong>, by writing to <a href=\"mailto:info@be-bloomer.it\">info@be-bloomer.it<\/a> and attaching:<\/p>\n<ul>\n<li>order number;<\/li>\n<li>photographs of the product and packaging documenting the defect or damage;<\/li>\n<li>detailed description of the encountered issue;<\/li>\n<li>for customized products: comparison with the approved proof\/sample.<\/li>\n<\/ul>\n<p>Following verification, Be-Bloomer will arrange for the replacement, repair, or refund of the product, as established by current regulations. The costs for returning defective or non-conforming products are borne by Be-Bloomer.<\/p>\n<h2>How to Exercise the Right of Withdrawal<\/h2>\n<p>Consumers intending to exercise the right of withdrawal (limited to Level 1 products \u2014 standard gadgets without customization) must send an explicit communication within 14 days of delivery to the address <a href=\"mailto:info@be-bloomer.it\">info@be-bloomer.it<\/a>, stating:<\/p>\n<ul>\n<li>order number and date of purchase;<\/li>\n<li>products subject to withdrawal;<\/li>\n<li>first name, last name, and address of the consumer.<\/li>\n<\/ul>\n<p>It is possible to use the model withdrawal form provided by Annex I, Part B of the Consumer Code, but its use is not mandatory: any explicit declaration sent via email is valid.<\/p>\n<p>Following the communication, the consumer must return the product within <strong>14 days<\/strong> from the date the withdrawal statement was sent, intact, in its original packaging, and complete with all accessories. Return shipping costs are the responsibility of the consumer.<\/p>\n<h2>Refund Procedures<\/h2>\n<p>Refunds are processed within <strong>14 days<\/strong> of receiving the withdrawal notice. Be-Bloomer reserves the right to suspend the refund until the returned product is received or, alternatively, until the consumer demonstrates that they have shipped it (e.g., via a tracked shipping receipt), whichever occurs first.<\/p>\n<p>The refund is made using the same payment method used by the client for the original order, unless expressly agreed otherwise:<\/p>\n<ul>\n<li><strong>Bank transfer<\/strong>: refund via transfer to the IBAN provided by the client;<\/li>\n<li><strong>Credit\/debit card (Stripe)<\/strong>: automatic reversal to the card used;<\/li>\n<li><strong>PayPal<\/strong>: refund credited to the original PayPal account.<\/li>\n<\/ul>\n<p>The refund includes the price of the product and the standard shipping costs incurred for the initial delivery.
